Article R3132-20-1 of the French Labour Code

I. – To qualify as a commercial area within the meaning of article L. 3132-25-1, the area for which a request for demarcation or modification has been made must meet the following criteria:

1° Constitute a commercial complex within the meaning ofarticle L. 752-3 of the French Commercial Code , with a total sales area in excess of 20,000 m2 ;

2° Have an annual customer base in excess of 2 million;

3° Have appropriate infrastructure and be accessible by individual and public transport.

II. – When the zone is located less than 30 kilometres from a competing offer located on the territory of a neighbouring State, the values applicable for the criteria of sales area and annual number of customers set out respectively in 1° and 2° of I are 2,000 m2 and 200,000 customers.

I. – Pour être qualifié de zone commerciale au sens de l’article L. 3132-25-1, la zone faisant l’objet d’une demande de délimitation ou de modification remplit les critères suivants :

1° Constituer un ensemble commercial au sens de l’article L. 752-3 du code de commerce d’une surface de vente totale supérieure à 20 000 m2 ;

2° Avoir un nombre annuel de clients supérieur à 2 millions ;

3° Etre dotée des infrastructures adaptées et accessible par les moyens de transport individuels et collectifs.

II. – Lorsque la zone est située à moins de 30 kilomètres d’une offre concurrente située sur le territoire d’un Etat limitrophe, les valeurs applicables au titre des critères de surface de vente et de nombre annuel de clients énoncés respectivement au 1° et au 2° du I sont de 2 000 m2 et de 200 000 clients.
