Article R314-5 of the French Consumer Code

The following are not included in the annual percentage rate of charge:
1° Costs relating to the acquisition of the properties mentioned in a of 1° of article L. 313-1 as well as the related taxes, notarial deed fees established pursuant to the section 3 of Chapter I of Title IV bis of Book IV of the Arrêtés part of the Code de commerce;
2° Costs payable by the borrower in the event of non-compliance with one of its obligations under the credit agreement.
Additional assumptions for calculating the annual percentage rate of charge are set out in the appendix to this code.

Ne sont pas compris dans le taux annuel effectif global :
1° Les frais liés à l’acquisition des immeubles mentionnés au a du 1° de l’article L. 313-1 tels que les taxes y afférentes, les frais d’acte notarié établis en application de la section 3 du chapitre Ier du titre IV bis du livre IV de la partie Arrêtés du code de commerce ;
2° Les frais à la charge de l’emprunteur en cas de non-respect de l’une de ses obligations prévues dans le contrat de crédit.
