Article R3163-5 of the French Labour Code

The exemption from the ban on night work for young workers is granted by the labour inspector for a maximum period of one year, renewable. The Labour Inspector will assess the particular characteristics of the activity justifying the exemption.
If no response is received within one month of the application being submitted, the authorisation is deemed to have been granted.

La dérogation à l’interdiction du travail de nuit des jeunes travailleurs est accordée par l’inspecteur du travail pour une durée maximale d’une année, renouvelable. Il apprécie les caractéristiques particulières de l’activité justifiant cette dérogation.
A défaut de réponse dans le délai d’un mois suivant le dépôt de la demande, l’autorisation est réputée accordée.
