The mutual union which is substituted for the reinsured companies under the conditions defined in Article R. 322-117-1 must inform the Autorité de contrôle prudentiel et de résolution of the conclusion, expiry, termination or amendment of such a treaty no later than two months before the treaty takes effect, its termination, expiry or the planned amendments.
The reinsured companies referred to in the first paragraph of Article R. 322-117-1 must, no later than two months before the termination or expiry of the treaty takes effect:
-provide evidence that they have entered into a new agreement to replace the terminated agreement, which has been approved by the Autorité de contrôle prudentiel et de résolution ;
-provide evidence that they have obtained administrative authorisation in accordance with the provisions of articles R. 321-1 et seq;
-provide evidence that they have obtained authorisation to transfer their portfolio of contracts to one or more authorised undertakings, in accordance with the conditions set out in Article R. 322-117-5 of the Code.
If they are unable to provide any of the above proofs, they are required to cease all underwriting and all contract renewals from the effective date of termination or expiry of the treaty; from this date, the operations of the companies concerned may be terminated at any time by decision of the Autorité de contrôle prudentiel et de résolution; the decision terminating operations has the same effect as a decision to withdraw administrative authorisation.
