Article R*322-117-5 of the French Insurance Code

The portfolio transfers referred to in Article L. 324-1 of the Code, relating to companies reinsured under the conditions defined in Article R. 322-117-1, are carried out by the mutual insurance association substituted for the reinsured companies in accordance with the provisions of the same Article, which acts on behalf of the companies for which it is substituted. The portfolio transfer notice and order referred to in Article L. 324-1 include an appendix listing the mutual insurance companies concerned by the transfer.

Les transferts de portefeuille visés à l’article L. 324-1 du code, relatifs à des sociétés réassurées dans les conditions définies à l’article R. 322-117-1, sont effectués par l’union de mutuelles substituée aux sociétés réassurées conformément aux dispositions du même article, qui agit pour le compte des sociétés auxquelles elle est substituée. L’avis et l’arrêté de transfert de portefeuille mentionnés à l’article L. 324-1 comportent en annexe la liste des sociétés d’assurance mutuelles concernées par le transfert.
