Article R322-120 of the French Insurance Code

The bodies referred to in Article L. 771-1 of the French Rural and Maritime Fishing Code are subject to the following requirements:

1° Their object must be either exclusively insurance or exclusively reinsurance;

2° They may not carry out insurance operations other than those mentioned in 2° and 3° of article L. 310-1;

3° They guarantee, in return for payment of a fixed or variable premium, full settlement of the commitments entered into with regard to their members, in the event of realisation of the risks covered by these commitments;

4° The risks they insure or reinsure may only be ceded or retroceded to organisations falling within the scope of this section and which, according to their articles of association, have departmental or regional competence in the case of reinsurance by a local organisation, or to the central body defined in Article L. 322-27-1 in the case of retrocessions by a departmental or regional organisation.

The provisions of Articles R. 322-83 and R. 322-84 do not apply to the above-mentioned bodies.

Article R322-120

Les organismes mentionnés à l’article L. 771-1 du code rural et de la pêche maritime sont soumis aux prescriptions suivantes :

1° Ils doivent avoir pour objet de pratiquer soit exclusivement des opérations d’assurance, soit exclusivement des opérations de réassurance ;

2° Ils ne peuvent pratiquer des opérations d’assurances autres que celles mentionnées au 2° et au 3° de l’article L. 310-1 ;

3° Ils garantissent, moyennant le paiement d’une cotisation fixe ou variable, le règlement intégral des engagements pris à l’égard de leurs adhérents, en cas de réalisation des risques faisant l’objet de ces engagements ;

4° La cession ou la rétrocession en réassurance des risques qu’ils assurent ou réassurent ne peut être effectuée qu’auprès d’organismes entrant dans le champ d’application de la présente section et ayant, d’après leurs statuts, une compétence départementale ou régionale s’il s’agit de la réassurance d’un organisme de caractère local, ou de l’organe central défini à l’article L. 322-27-1 s’il s’agit de rétrocessions effectuées par un organisme de caractère départemental ou régional.

Les dispositions des articles R. 322-83 et R. 322-84 ne sont pas applicables aux organismes mentionnés ci-dessus.
