The subscription of a reinsurance treaty, under the conditions provided for in Article R. 322-132, by an undertaking which has obtained administrative authorisation, has the effect of suspending the validity of that authorisation.
In the event of termination of the said treaty or amendment of the clause providing for the substitution of the reinsurer for the reinsured undertaking, the authorisation will not be reinstated and the undertaking concerned may only continue its operations in this capacity with the authorisation of the Autorité de contrôle prudentiel et de résolution, which may in particular require it to present sufficient guarantees to enable it to meet its commitments.
If it is unable to provide such guarantees, and if it has not entered into a new treaty to replace the old one within two months of the effective date of the termination or modification, its portfolio will be transferred or its operations terminated in accordance with the conditions set out in the last three paragraphs of article R. 322-133.
