Article R322-139 of the French Insurance Code

The tontines referred to in article L. 322-26-4 group their members into separate groups known as associations and, on the expiry of each association, distribute the funds arising from the joint capitalisation of their contributions, after deduction of the portion allocated to statutory management and acquisition costs, among the survivors of the associations in the event of survival or among the beneficiaries of the deceased members of the associations in the event of death, taking into account the age of the members and their contributions.

The companies governed by this section must include after their name, in their articles, contracts or securities issued by them and other documents of any kind intended to be distributed to the public or published, the following words in uniform characters: “société à forme tontinière”.

Les sociétés à forme tontinière mentionnées à l’article L. 322-26-4 réunissent leurs adhérents en groupes distincts dénommés associations et répartissent, à l’expiration de chacune de ces associations, les fonds provenant de la capitalisation en commun de leurs cotisations, déduction faite de la partie affectée aux frais de gestion et d’acquisition statutaires, entre les survivants des associations en cas de vie ou entre les ayants droit des décédés des associations en cas de décès, en tenant compte de l’âge des adhérents et de leurs versements.

Les sociétés régies par la présente section doivent faire figurer à la suite de leur dénomination, dans leurs statuts, contrats ou titres émis par elles et autres documents de toute nature destinés à être distribués au public ou publiés, la mention ci-après en caractères uniformes : ” société à forme tontinière “.
