Article R322-4 of the French Insurance Code

When a company carries out one or more of the branches or sub-branches mentioned in article R. 321-1 in one of the territories of New Caledonia, French Polynesia, Saint-Pierre-et-Miquelon, the French Southern and Antarctic Territories or Wallis and Futuna, it must obtain authorisation from the prefect or the head of the territory for a special agent, a natural person, responsible for managing all the operations it carries out in this department or territory.

Acceptance of the special agent may only be refused by the Prefect or Head of Territory on the grounds of good character or technical qualification.

Article R322-4

Lorsqu’une entreprise pratique une ou plusieurs des branches ou sous-branches mentionnées à l’article R. 321-1 dans l’un des territoires de la Nouvelle-Calédonie, de la Polynésie française, de Saint-Pierre-et-Miquelon, des Terres australes et antarctiques françaises ou de Wallis et Futuna, elle doit obtenir l’habilitation, par le préfet ou le chef de territoire d’un agent spécial, personne physique, préposé à la direction de toutes les opérations qu’elle pratique dans ce département ou territoire.

L’acceptation de l’agent spécial ne peut être refusée par le préfet ou le chef de territoire que pour des motifs touchant à l’honorabilité ou à la qualification technique.
