Article R*322-51 of the French Insurance Code

When the conditions set out in articles R. 322-47 to R. 322-50 have been met, the signatories of the original deed or their authorised representatives shall declare this before a notary.

This declaration must be accompanied by

1° A duly certified list of the names of the members, showing their surnames, forenames, positions and domiciles, and, if applicable, the names and registered offices of the member companies, the amount of securities insured by each member and the amount of their contributions;

2° One of the duplicates of the partnership deed, if it is a private deed, or a copy if it is notarised and if it was executed before a notary other than the one who receives the declaration;

3° A statement of the contributions paid by each member;

4° A statement of the sums paid to set up the establishment fund;

5° A certificate from the notary stating that the funds were paid in prior to the declaration provided for in this article.

Article R*322-51

Lorsque les conditions prévues aux articles R. 322-47 à R. 322-50 sont remplies, les signataires de l’acte primitif ou leurs fondés de pouvoirs le constatent par une déclaration devant notaire.

A cette déclaration sont annexés :

1° La liste nominative dûment certifiée des adhérents contenant leurs nom, prénoms, qualité et domicile, et s’il y a lieu, la dénomination et le siège social des sociétés adhérentes, le montant des valeurs assurées par chacun d’eux et le chiffre de leurs cotisations ;

2° L’un des doubles de l’acte de société, s’il est sous seing privé, ou une expédition s’il est notarié et s’il a été passé devant un notaire autre que celui qui reçoit la déclaration ;

3° L’état des cotisations versées par chaque adhérent ;

4° L’état des sommes versées pour la constitution du fonds d’établissement ;

5° Un certificat du notaire constatant que les fonds ont été versés préalablement à la déclaration prévue au présent article.
