Article R322-74 of the French Insurance Code

Surpluses distributable in accordance with articles R. 322-77 and R. 322-106 are allocated on a priority basis to early repayment of the loan mentioned in article R. 322-49 in proportion to the subscriptions of each member.

When the company takes the initiative to deregister a member, the member may request immediate repayment of his contribution to the loan. The same applies if the member makes use of the right provided for in the second paragraph of article R. 113-10.

Les excédents distribuables en application des articles R. 322-77 et R. 322-106 sont affectés par priorité à des remboursements anticipés de l’emprunt mentionné à l’article R. 322-49 proportionnels aux souscriptions de chaque sociétaire.

Lorsque la société prend l’initiative de radier un sociétaire, celui-ci peut demander à être immédiatement remboursé de sa contribution à cet emprunt. Il en est de même lorsque le sociétaire fait usage du droit prévu au deuxième alinéa de l’article R. 113-10.
