Article R334-32 of the French Insurance Code

The undertakings referred to in Article R. 310-10-1, authorised on 4 July 1993 to conduct one or more of the classes of business referred to in Article R. 321-1 within the territory of the French Republic, and which comply with the permanent regulatory provisions relating to technical provisions, the solvency margin and the guarantee fund, as well as the undertakings referred to in 1° of Article L. 310-10-1, which comply with the same provisions, may obtain from the Autorité de contrôle des assurances et des mutuelles the removal of restrictive measures, such as mortgages, deposits or sureties, which had been imposed on them by virtue of the regulations previously applicable to them.

Les entreprises mentionnées à l’article R. 310-10-1, agréées à la date du 4 juillet 1993 pour pratiquer sur le territoire de la République française une ou plusieurs des branches mentionnées à l’article R. 321-1, et qui satisfont aux dispositions réglementaires permanentes relatives aux provisions techniques, à la marge de solvabilité et au fonds de garantie ainsi que les entreprises visées au 1° de l’article L. 310-10-1, qui satisfont aux mêmes dispositions, peuvent obtenir de l’Autorité de contrôle des assurances et des mutuelles la suppression des mesures restrictives, telles qu’hypothèques, dépôts ou cautionnements, qui leur avaient été imposées en vertu de la réglementation qui leur était précédemment applicable.
