Article R342-12-1 of the French Tourism Code

Except where the safety management system is subject to periodic inspection under the conditions laid down in article R. 342-12-2, its guidelines and any modifications to them must be approved by the Prefect of the département in which the facility concerned is located before it begins operating or before the modification is implemented. The Prefect may temporarily authorise derogations from the guidelines of the safety management system.

The procedures for applying this article are specified by order of the Minister responsible for transport.

Article R342-12-1

Sauf lorsque le système de gestion de la sécurité est soumis à un contrôle périodique dans les conditions prévues à l’article R. 342-12-2, ses orientations et leurs modifications doivent être approuvées par le préfet du département dans lequel est implantée l’installation concernée avant le début de son exploitation ou avant la mise en œuvre de la modification. Le préfet peut autoriser temporairement des dérogations aux orientations du système de gestion de la sécurité.

Les modalités d’application du présent article sont précisées par arrêté du ministre chargé des transports.
