Article R342-16 of the French Tourism Code

The approvals referred to in articles R. 342-5 and R. 342-15 may stipulate that the work carried out by their beneficiaries is limited to certain categories of equipment and certain categories of checks.

Approval may be suspended or withdrawn if it is found that one of the conditions under which it was issued is no longer met, or in the event of failure to comply with the regulations. This suspension or withdrawal is pronounced after the holder has been given the opportunity to present his observations. In an emergency, the licence is suspended immediately.

A decree by the Minister for Transport specifies the conditions for issuing the aforementioned approvals, particularly with regard to the qualifications, skills and resources required of applicants, as well as the conditions for suspension or withdrawal.

Les agréments mentionnés aux articles R. 342-5 et R. 342-15 peuvent prévoir que les interventions de leurs bénéficiaires sont limitées à certaines catégories d’appareils et à certaines catégories de vérifications.

L’agrément peut être suspendu ou retiré s’il est constaté qu’une des conditions de sa délivrance n’est plus remplie ou en cas d’inobservation de la réglementation. Cette suspension ou ce retrait est prononcé après que le titulaire a été mis à même de présenter ses observations. En cas d’urgence, la suspension de l’agrément est immédiate.

Un arrêté du ministre chargé des transports précise les conditions de délivrance des agréments précités notamment en ce qui concerne la qualification, les compétences et les moyens requis de la part des demandeurs ainsi que les conditions de suspension ou de retrait.
