Article R342-17 of the French Tourism Code

Any modification likely to affect the safety of a ski lift or conveyor belt must be declared to the prefect at least one month before it is implemented. To this end, the project owner must send the Prefect a file describing the planned modification and including, where applicable, the safety report provided for in Article 8 of Regulation (EU) 2016/424 of the European Parliament and of the Council of 9 March 2016 on cableway installations and repealing Directive 2000/9/EC as amended.

If, on the basis of the dossier submitted, it emerges that the planned modification significantly alters the main characteristics of the installation, its location and the nature of the works or its transport capacity, the Prefect may, within a period not exceeding one month, submit it for the authorisation provided for in Article L. 472-1 of the Planning Code.

Toute modification susceptible d’affecter la sécurité d’une remontée mécanique ou d’un tapis roulant fait l’objet d’une déclaration au préfet au moins un mois avant sa mise en oeuvre. A cette fin, le maître d’ouvrage transmet au préfet un dossier décrivant la modification envisagée et comprenant, le cas échéant, le rapport de sécurité prévu par l’article 8 du règlement (UE) 2016/424 du Parlement européen et du Conseil du 9 mars 2016 relatif aux installations à câbles et abrogeant la directive 2000/9/ CE pour la partie modifiée.

Si, au vu du dossier transmis, il ressort que la modification envisagée remet en cause de manière significative les caractéristiques principales de l’installation, son emplacement et la nature des ouvrages ou sa capacité de transport, le préfet peut, dans un délai ne pouvant excéder un mois, la soumettre à l’autorisation prévue à l’article L. 472-1 du code de l’urbanisme.
