Article R343-6 of the French Insurance Code

The charge constituted by the allocation to the provision for liquidity risk mentioned in article R. 343-5 may be deferred under conditions specified by order of the Minister for the Economy. However, the deferral of charges resulting from this spreading may not result in the total charge relating to the provisioning of the overall unrealised loss mentioned in article R. 343-5 for a given financial year being borne over more than eight consecutive financial years, starting from the financial year in which this overall unrealised loss was recorded.

When a provision for the risk of default is set up in a sub-accounting system established by virtue of the present code, the deferral of the charge is recorded in the company’s accounts and does not affect this sub-accounting system.

Article R343-6

La charge constituée par la dotation à la provision pour risque d’exigibilité mentionnée à l’article R. 343-5 peut être étalée dans des conditions précisées par arrêté du ministre chargé de l’économie. Le report de charge consécutif à cet étalement ne peut toutefois pas conduire à ce que la charge totale relative au provisionnement de la moins-value latente globale mentionnée à l’article R. 343-5 pour un exercice donné soit supportée sur plus de huit exercices consécutifs, à compter de l’exercice où cette moins-value latente globale a été constatée.

Lorsqu’une provision pour risque d’exigibilité est constituée dans une comptabilité auxiliaire d’affectation établie en vertu du présent code, le report de la charge est constaté dans les comptes de l’entreprise et n’affecte pas cette comptabilité auxiliaire.
