Article R351-21 of the French Insurance Code

Surplus funds consist of accumulated profits which have not yet been made available for distribution to policyholders, contract beneficiaries and reinsured undertakings.

These surplus funds are not considered as insurance and reinsurance commitments insofar as they meet the criteria set out in 1° of article R. 351-23.

Les fonds excédentaires sont constitués de bénéfices accumulés qui n’ont pas encore été rendus disponibles pour distribution aux assurés, aux souscripteurs, aux bénéficiaires de contrats et aux entreprises réassurées.


Ces fonds excédentaires ne sont pas considérés comme des engagements d’assurance et de réassurance dans la mesure où ils satisfont aux critères énoncés au 1° de l’article R. 351-23.
