Where a supervisory authority of another Member State transmits to the Autorité de contrôle prudentiel et de résolution a proposal similar to those mentioned in II or III of Article R. 356-26 with respect to a subsidiary having its head office in that Member State, the Autorité de contrôle prudentiel et de résolution shall endeavour to reach a decision with the other supervisory authorities of the college of supervisors on this proposal or on other possible measures. This decision is binding on the Autorité de contrôle prudentiel et de résolution.
Where the Autorité de contrôle prudentiel et de résolution, in its capacity as group supervisor, disagrees with the supervisory authority of another Member State on a proposal similar to those mentioned in II or III of Article R. 356-26 in respect of a subsidiary having its registered office in that Member State, it may, within one month of the transmission of that proposal, refer the matter to the European Insurance and Occupational Pensions Authority in accordance with Article 19 of Regulation (EU) No 1094/2010 of the European Parliament and of the Council of 24 November 2010.
The decision taken in accordance with the decision of the European Insurance and Occupational Pensions Authority is binding on the Autorité de contrôle prudentiel et de résolution.
