Article R356-48-1 of the French Insurance Code

The purpose of the compliance function referred to in the second paragraph of Article L. 356-1 is, in particular, to advise the Chief Executive Officer or the Management Board, as well as the Board of Directors or the Supervisory Board of the participating or parent undertaking referred to in the second or third paragraph of Article L. 356-2 respectively, on all matters relating to compliance with the laws, regulations and administrative provisions governing the taking up and pursuit of insurance and reinsurance activities.

This function also aims to assess the possible impact of any change in the legal environment on the operations of the group concerned, and to identify and assess compliance risk.

La fonction de vérification de la conformité mentionnée au deuxième alinéa de l’article L. 356-1 a notamment pour objet de conseiller le directeur général ou le directoire ainsi que le conseil d’administration ou le conseil de surveillance de l’entreprise participante ou mère mentionnée respectivement au deuxième ou troisième alinéa de l’article L. 356-2, sur toutes les questions relatives au respect des dispositions législatives, réglementaires et administratives afférentes à l’accès aux activités de l’assurance et de la réassurance et à leur exercice.


Cette fonction vise également à évaluer l’impact possible de tout changement de l’environnement juridique sur les opérations du groupe concerné, ainsi qu’à identifier et évaluer le risque de conformité.
