Article R356-8 of the French Insurance Code

Articles R. 356-9 to R. 356-22 apply to the participating and parent undertakings mentioned respectively in the second and third paragraphs of Article L. 356-2.

For the purposes of the solvency calculation referred to in the first paragraph of Article R. 356-10, the parent undertaking referred to in the third paragraph of Article L. 356-2 is treated as an insurance or reinsurance undertaking subject to the rules laid down in Chapter I, Section 3 and Chapter II, Section 1 of this Title and in Articles L. 352-1 to L. 352-1-3 and R. 352-2 to R. 352-24 as regards the Solvency Capital Requirement and the own funds eligible for cover.

Les articles R. 356-9 à R. 356-22 s’appliquent aux entreprises participantes et mères mentionnées respectivement aux deuxième et troisième alinéas de l’article L. 356-2.

Aux fins du calcul de solvabilité mentionné au premier alinéa de l’article R. 356-10, l’entreprise mère mentionnée au troisième alinéa de l’article L. 356-2 est traitée comme une entreprise d’assurance ou de réassurance soumise aux règles fixées aux chapitre I, section 3, et chapitre II, section 1, du présent titre et aux articles L. 352-1 à L. 352-1-3 et R. 352-2 à R. 352-24 en ce qui concerne le capital de solvabilité requis et les fonds propres éligibles à sa couverture.
