Article R370-9 of the French Insurance Code

The file referred to in 1° of article L. 370-8 shall include the following information:

1° The written agreement between the supplementary occupational pension fund and the institution for occupational retirement provision, which must specify the terms and conditions of the transfer;

2° A description of the main characteristics of the contracts transferred;

3° A description of the commitments and technical provisions to be transferred, the other obligations and rights attached to these commitments and a list of the corresponding assets or their valuation;

4° The name and location of the registered office of the supplementary occupational pension fund and the institution for occupational retirement provision, respectively, as well as the Member States in which each of them is registered or authorised;

5° The name and location of the registered office of the subscribing employer or group of employers referred to in 1° of Article L. 143-1 or the subscribing association and the name of the latter;

6° Proof of the prior agreement referred to in article L. 370-7;

7° Where applicable, the designation of the Member States whose social and labour law legislation relating to occupational pension schemes is applicable to the transferred contracts.

Le dossier mentionné au 1° de l’article L. 370-8 comporte les éléments suivants :

1° L’accord écrit intervenu entre le fonds de retraite professionnelle supplémentaire et l’institution de retraite professionnelle, lequel doit préciser les conditions du transfert ;

2° La description des principales caractéristiques des contrats transférés ;

3° La description des engagements et des provisions techniques à transférer, des autres obligations et droits attachés à ces engagements ainsi que la liste des actifs correspondants ou leur valorisation ;

4° La désignation et le lieu du siège, respectivement, du fonds de retraite professionnelle supplémentaire et de l’institution de retraite professionnelle, ainsi que la désignation des États membres dans lesquels chacun d’eux est enregistré ou agréé ;

5° La désignation et le lieu du siège, dont relève l’employeur souscripteur ou le groupe d’employeurs mentionnés au 1° de l’article L. 143-1 ou l’association souscriptrice et le nom de ces derniers ;

6° La preuve de l’accord préalable mentionné à l’article L. 370-7 ;

7° Le cas échéant, la désignation des Etats membres dont la législation en matière de droit social et de droit du travail relative aux régimes de retraite professionnelle est applicable aux contrats transférés.
