Article R3711-17 of the French Public Health Code

The provisions of this section are implemented, as far as possible, prior to the release of a convicted prisoner.

However, when the person has been convicted of a crime referred to inarticle 706-53-13 of the Code of Criminal Procedure, the person must be summoned by the coordinating doctor in accordance with the provisions of article R. 3711-12 of this Code before being released or before the end of the period of secure detention. The choice of attending physician, in accordance with the provisions of articles R. 3711-12 to R. 3711-16, is made before this release or before the end of the period of secure detention.

For the application of the provisions of the two previous paragraphs, the person may be granted leave or, where applicable, escorted leave in order to meet with the coordinating doctor and their attending doctor.

Les dispositions de la présente section sont mises en œuvre, dans la mesure du possible, avant la libération d’un condamné détenu.

Toutefois, lorsque la personne a été condamnée pour un crime mentionné à l’article 706-53-13 du code de procédure pénale, la convocation de cette personne par le médecin coordonnateur réalisée conformément aux dispositions de l’article R. 3711-12 du présent code doit intervenir avant sa libération ou la cessation de sa rétention de sûreté. Le choix de médecin traitant, conformément aux dispositions des articles R. 3711-12 à R. 3711-16, intervient avant cette libération ou avant la cessation de la rétention de sûreté.

Pour l’application des dispositions des deux alinéas précédents, la personne peut bénéficier de permissions de sortir ou, le cas échéant, d’autorisations de sortie sous escorte afin de rencontrer le médecin coordonnateur et son médecin traitant.
