Article R383-1 of the French Insurance Code

The first and second paragraphs of article R. 325-2, articles R. 325-10 to R. 325-12 and I of article R. 325-13 apply to the withdrawal of authorisation of supplementary occupational pension funds.

For the application of these provisions :

1° “supplementary occupational pension fund” shall be understood to mean: “undertakings referred to in Article L. 310-2”, “undertakings” or “insurance or reinsurance undertakings”;

2° The reference to Article L. 321-1 is replaced by the reference to Article L. 382-1, the reference to Article L. 321-10-2 is replaced by the reference to Article L. 382-3 and the reference to Article L. 325-1 is replaced by the reference to Article L. 383-1.

Article R383-1

Les premier et deuxième alinéas de l’article R. 325-2, les articles R. 325-10 à R. 325-12 et le I de l’article R. 325-13 sont applicables pour le retrait d’agrément des fonds de retraite professionnelle supplémentaire.

Pour l’application de ces dispositions :

1° Il y a lieu d’entendre : “ fonds de retraite professionnelle supplémentaire ” là où sont mentionnées : “ entreprises mentionnées à l’article L. 310-2 ”, “ entreprises ” ou “ entreprises d’assurance ou de réassurance ” ;

2° La référence à l’article L. 321-1 est remplacée par la référence à l’article L. 382-1, la référence à l’article L. 321-10-2 est remplacée par la référence à l’article L. 382-3 et la référence à l’article L. 325-1 est remplacée par la référence à l’article L. 383-1.
