I. – Articles R. 354-2-1, R. 354-3-2 and R. 354-3-3 do not apply to supplementary occupational pension funds.
II. – For the application of article R. 354-3 to supplementary occupational pension funds, the following definitions apply
1° “Solvency requirements referred to in Section 2 of Chapter V of Title VIII of Book III” where “capital requirements referred to in Chapter II of this Title” are mentioned;
2° “Requirements relating to the technical provisions set out in Section 1 of Chapter V of Title VIII of Book III” where it is referred to as “requirements relating to prudential technical provisions set out in Section 2 of Chapter I of this Title”;
3° “The minimum required solvency margin resulting from the calculation provided for in Section 2 of Chapter V of Title VIII of Book III” where it states: “the assumptions underlying the Solvency Capital Requirement provided for in Article R. 352-2, calculated using the standard formula in accordance with Subsection 2 of Section 1 of Chapter II of this Title, or using a partial or full internal model in accordance with Subsection 3 of Section 1 of Chapter II of this Title”.
III. – Chapter IX of Title I of Commission Delegated Regulation (EU) 2015/35 of 10 October 2014 supplementing Directive 2009/138/EC of the European Parliament and of the Council on the taking-up and pursuit of the business of Insurance and Reinsurance (Solvency II), in the version in force on the date of publication of Decree 2017-1171 of 18 July 2017 laying down the rules applicable to supplementary occupational pension funds, is applicable to supplementary occupational pension funds, with the exception of 2 to 4 of Article 260, d of 1 and 4 of Article 272 and Articles 263 to 265.
For the purposes of the previous paragraph, the following definitions apply:
1° “Minimum Solvency Margin Requirement” where “Solvency Capital Requirement” is mentioned;
2° “Compliance with Section 1 of this Chapter” where it is stated: “Compliance with Article 75 of Directive 2009/138/EC”;
3° “Requirements set out in Section 1 of this Chapter” where it reads: “Requirements set out in Articles 75 to 86 of Directive 2009/138/EC”.
