The report on the solvency and financial situation referred to in Article L. 385-7 is approved by the Board of Directors or the Supervisory Board. It contains the following information, either in full or by direct and precise reference to information which is equivalent, both in nature and scope, to that published pursuant to other legislative or regulatory provisions:
1° A description of the business and results of the supplementary occupational pension fund ;
2° A description of the system of governance and an assessment of its appropriateness to the risk profile of the supplementary occupational pension fund;
3° A description, separately for each risk category, of the risk exposure, risk concentrations, risk mitigation and risk sensitivity;
4° A description, separately for assets, technical provisions and other liabilities, of the bases and methods used for their valuation, together with an explanation of any major differences from the bases and methods used for their valuation in the financial statements;
5° A description of how capital is managed, including at least the following items:
a) The capital structure ;
b) The amounts of the minimum solvency margin requirement and the guarantee fund;
c) In the event of a shortfall in the guarantee fund or a serious breach of the minimum solvency margin requirement during the period under review, the amount of the shortfall, even if the problem has subsequently been resolved, together with an explanation of its origin and consequences and of any remedial action taken. This description includes an analysis of any material changes from the previous period under review and an explanation of any material differences in the financial statements in the value of the items under review, as well as a brief presentation of the transferability of capital;
6° The annual accounts, in sufficient detail to take account of each pension scheme managed by the fund;
7° Where applicable, annual accounts and annual reports for each pension scheme.
An order of the Minister for the Economy specifies the detailed information that funds must provide as part of the report on their solvency and financial situation.
