Article R4061-6 of the French Public Health Code

When a health professional registered on the roll of a professional association or registered with a regional health agency is likely to come under the provisions of article L. 4138-2 of the Defence Code, he must apply to be removed from the roll of the association to which he belongs or from the list maintained by the regional health agency.

The request, sent by any means that provides a date certain, is accompanied by the decision of the Minister of Defence stating the date on which the person concerned comes under the provisions of this article L. 4138-2. The person is struck off the list no later than the day before this date.

Lorsqu’un professionnel de santé inscrit à un tableau d’un ordre professionnel ou enregistré auprès d’une agence régionale de santé a vocation à relever des dispositions de l’article L. 4138-2 du code de la défense, il est tenu de demander sa radiation du tableau de l’ordre dont il relève ou de la liste tenue par l’agence régionale de santé.

Sa demande, adressée par tout moyen permettant de lui donner date certaine, est accompagnée de la décision du ministre de la défense mentionnant la date à laquelle l’intéressé relève des dispositions de cet article L. 4138-2. La radiation intervient au plus tard la veille de cette date.
