Article R4111-12 of the French Public Health Code

The Director General of the Centre National de Gestion, acting on behalf of the Minister for Health, will issue the authorisation to practise provided for in I of article L. 4111-2, after obtaining the opinion of the commission, on the basis of an application accompanied by a file containing the documents specified by order of the Minister for Health.

This application is submitted at the end of the skills consolidation programme.

If the competent authority remains silent for one year on the applications submitted in application of I, from receipt of a complete application, it will be deemed to have rejected the application.

This period may be extended by two months, by decision of the competent authority notified no later than one month before its expiry, in the event of serious difficulty in assessing the applicant’s professional experience.

In the event of refusal, the decision of the Director General of the Centre National de Gestion shall state the reasons on which it is based.

The ministerial authorisation to practise is published in the Journal officiel de la République française.

Article R4111-12

Le directeur général du Centre national de gestion, au nom du ministre chargé de la santé, délivre, après avis de la commission, l’autorisation d’exercice prévue au I de l’article L. 4111-2, au vu d’une demande accompagnée d’un dossier comportant les pièces prévues par arrêté de ce ministre.

Cette demande est présentée à l’issue du parcours de consolidation des compétences.

Le silence gardé par l’autorité compétente pendant un an sur les demandes présentées en application du I, à compter de la réception d’un dossier complet, vaut décision de rejet.

Ce délai peut être prolongé de deux mois, par décision de l’autorité compétente notifiée au plus tard un mois avant l’expiration de celui-ci, en cas de difficulté sérieuse portant sur l’appréciation de l’expérience professionnelle du candidat.

En cas de refus, la décision du directeur général du Centre national de gestion est motivée.

L’autorisation ministérielle d’exercice est publiée au Journal officiel de la République française.
