Appeals to the National Council do not have suspensive effect.
Subject to the following provisions, the provisions of article R. 4112-5 are applicable before the national council.
When submitted by the departmental council, the appeal must be accompanied by the decision to lodge an appeal.
The decision is notified in the manner laid down in article R. 4112-4 and to the regional or inter-regional council.
The notification states that the decision may be appealed to the Conseil d’Etat within two months.
The national council shall inform the departmental councils of decisions to refuse registration taken by the departmental councils, the regional or inter-regional councils and the national council.
The powers of the president defined in this article are exercised by the president of the restricted formation of the national council when it has been set up in application of article L. 4124-11.
