Article R4112-5-1 of the French Public Health Code

Appeals to the National Council do not have suspensive effect.

Subject to the following provisions, the provisions of article R. 4112-5 are applicable before the national council.

When submitted by the departmental council, the appeal must be accompanied by the decision to lodge an appeal.

The decision is notified in the manner laid down in article R. 4112-4 and to the regional or inter-regional council.

The notification states that the decision may be appealed to the Conseil d’Etat within two months.

The national council shall inform the departmental councils of decisions to refuse registration taken by the departmental councils, the regional or inter-regional councils and the national council.

The powers of the president defined in this article are exercised by the president of the restricted formation of the national council when it has been set up in application of article L. 4124-11.

Article R4112-5-1

Le recours devant le conseil national n’a pas d’effet suspensif.

Sous réserve des dispositions qui suivent, les dispositions de l’article R. 4112-5 sont applicables devant le conseil national.

Le recours, lorsqu’il est présenté par le conseil départemental, est accompagné de la délibération décidant de former un recours.

La décision est notifiée selon les modalités fixées par l’article R. 4112-4 ainsi qu’au conseil régional ou interrégional.

La notification mentionne que la décision est susceptible de recours devant le Conseil d’Etat dans le délai de deux mois.

Le conseil national informe les conseils départementaux des décisions de refus d’inscription prises par les conseils départementaux, les conseils régionaux ou interrégionaux et le conseil national.

Les pouvoirs du président définis au présent article sont exercés par le président de la formation restreinte du conseil national lorsqu’elle a été constituée en application de l’article L. 4124-11.
