Article R421-28 of the French Insurance Code

The rates of the contributions referred to in Article R. 421-27 are set by order of the Minister responsible for insurance, subject to the following maximum amounts:

-Contribution from insurance companies in respect of the motor section: 12% of the total expenses of this section.

-Contribution from those responsible for uninsured accidents: 10% of the compensation payable by them. However, this rate is reduced to 5% when the accident was caused by a vehicle used by the State or a foreign State for which the certificate provided for in article R. 211-25 has been supplied. It is also reduced to 5% of the indemnities remaining at their own expense for beneficiaries of excess insurance.

-Contribution from the insured: 2% of the premiums mentioned in 3° of article R. 421-27.

Article R421-28

Les taux des contributions mentionnées à l’article R. 421-27 sont fixés par arrêté du ministre chargé des assurances dans la limite des montants maximaux ci-après :

-Contribution des entreprises d’assurance au titre de la section automobile : 12 % de la totalité des charges de cette section.

-contribution des responsables d’accidents non assurés : 10 % des indemnités restant à leur charge. Toutefois, ce taux est ramené à 5 % lorsque l’accident a été provoqué par un véhicule utilisé par l’Etat ou un Etat étranger pour lequel a été fournie l’attestation prévue à l’article R. 211-25. Il est également ramené à 5 % des indemnités restant à leur propre charge pour les bénéficiaires d’une assurance avec franchise.

-contribution des assurés : 2 % des primes mentionnées au 3° de l’article R. 421-27.
