Article R421-35 of the French Code governing the entry and residence of foreign nationals and the right of asylum

A foreign national applying for the issue of a multi-annual residence permit bearing the wording “talent passport” provided for in article L. 421-18 may be considered as making a direct economic investment within the meaning of the same article when, personally or through a company that he/she manages or in which he/she holds at least 30% of the capital, he/she meets the following cumulative conditions:
1° Create or safeguard or undertake to create or safeguard employment in the four years following the investment on French territory;
2° Carry out or undertake to carry out on French territory an investment in tangible or intangible fixed assets of at least 300,000 euros.

L’étranger qui sollicite la délivrance de la carte de séjour pluriannuelle portant la mention ” passeport talent ” prévue à l’article L. 421-18 peut être regardé comme procédant à un investissement économique direct au sens du même article lorsque, personnellement ou par l’intermédiaire d’une société qu’il dirige ou dont il détient au moins 30 % du capital, il remplit les conditions cumulatives suivantes :
1° Créer ou sauvegarder ou s’engager à créer ou sauvegarder de l’emploi dans les quatre années qui suivent l’investissement sur le territoire français ;
2° Effectuer ou s’engager à effectuer sur le territoire français un investissement en immobilisations corporelles ou incorporelles d’au moins 300 000 euros.
