Article R421-40 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The multi-annual residence permit bearing the words “salarié détaché ICT”, “salarié détaché mobile ICT”, “salarié détaché ICT (famille)” or “salarié détaché mobile ICT (famille)” provided for in articles L. 421-26 to L. 421-29 is withdrawn in the following situations:
1° The establishment or company employing the foreigner who holds it was set up in France with the main aim of facilitating the entry and residence of foreigners carrying out a mission on French territory within the scope of 2° of article L. 1262-1 of the Labour Code;
2° The foreigner’s employer or host company has been convicted pursuant to article L. 8256-1 of the same code.

Article R421-40

La carte de séjour pluriannuelle portant la mention ” salarié détaché ICT “, ” salarié détaché mobile ICT “, ” salarié détaché ICT (famille) ” ou ” salarié détaché mobile ICT (famille) ” prévue aux articles L. 421-26 à L. 421-29 est retirée dans les situations suivantes :
1° L’établissement ou l’entreprise d’emploi de l’étranger qui en est titulaire a été créé en France dans le but principal de faciliter l’entrée et le séjour d’étrangers effectuant une mission sur le territoire français dans le cadre du 2° de l’article L. 1262-1 du code du travail ;
2° L’employeur ou l’entreprise d’accueil de l’étranger a été condamné en application de l’article L. 8256-1 du même code.
