Article R421-42 of the French Insurance Code

The public accountants who record extracts of judgements and settlements in accordance with the provisions of decree no. 66-136 of 4 March 1966 recover, under the same conditions as fines, the surcharge of 50% introduced for the benefit of the guarantee fund by the second paragraph of article L. 421-8 of the Insurance Code. Receipts from this surcharge are paid quarterly to the guarantee fund.

Les comptables publics, consignataires des extraits des jugements et d’arrêts ainsi que des décisions de transaction intervenues conformément aux dispositions du décret n° 66-136 du 4 mars 1966 recouvrent, dans les mêmes conditions que les amendes, la majoration de 50 % instituée au profit du fonds de garantie par le deuxième alinéa de l’article L. 421-8 du code des assurances. Les encaissements effectués au titre de cette majoration sont versés trimestriellement au fonds de garantie.
