The liquidator appointed by the Autorité de contrôle prudentiel et de résolution in application of articles L. 326-1 and L. 326-2, or by the competent authorities of the home state of an insurance undertaking whose registered office is located in the territory of a Member State of the European Union other than France, shall refer to the guarantee fund the claims of policyholders, subscribers or beneficiaries of benefits provided for in the insurance contract as soon as he is aware of them.
At the request of and on behalf of the guarantee fund, the liquidator carries out the investigations and formalities required to bring the actions provided for in the last paragraph of article R. 211-13 and, where applicable, to bring claims against those jointly liable and the persons mentioned in the fourth and fifth paragraphs of article L. 421-9-4. The sums recovered by the fund as a result of these actions are paid directly to it and are deducted from its claim against the liquidation.
