Article R421-9 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When foreign nationals present a project for the creation of a commercial, industrial or craft activity, they must request an opinion on the economic viability of the project from the department in charge of foreign labour responsible for the département in which they wish to carry out their project, prior to submitting their application for the residence permit provided for in article L. 421-5.

Lorsque l’étranger présente un projet tendant à la création d’une activité commerciale, industrielle ou artisanale, il sollicite, préalablement au dépôt de sa demande tendant à la délivrance de la carte de séjour prévue à l’article L. 421-5, un avis sur la viabilité économique du projet auprès du service en charge de la main d’œuvre étrangère compétent pour le département dans lequel il souhaite réaliser son projet.
