If the claim for compensation has been brought before a civil court under the conditions set out in article R. 421-7, the victim or his rightful claimants may, if the conditions set out in 1° of article R. 421-8 are met, ask the insurer to pay the sums awarded to them under articles 514, 515, 789 and 834 to 837 of the Code of Civil Procedure, and which would be paid to them by the guarantee fund if the settlement were made by the latter.
The insurer is then required to pay the aforementioned sums on behalf of whomever it chooses. If the insurer fails to fulfil this obligation, it may be forced to do so by an order issued by the interim relief judge at the request of the victim or his beneficiaries.
