In the event of a medical examination being carried out on the victim of an act of terrorism at the request of the guarantee fund, the latter shall inform the victim at least fifteen days before the date of the examination of the identity and qualifications of the doctor responsible for carrying out the examination, as well as the purpose, date and place of the examination. They will also be informed that they may be assisted by a doctor of their choice.
Within thirty days of the examination, the doctor sends a preliminary report to the guarantee fund, the victim and, if applicable, their lawyers and the doctor who assisted the victim. They have a period of thirty days from receipt of the report in which to submit their written observations.
The doctor’s final report must mention the action taken on the parties’ observations. It must be sent within twenty days to the guarantee fund, to the victim and, where applicable, to their lawyers and to the doctor who assisted the victim. This period runs from the date of receipt of the last observations.
If the victim’s injury has not been consolidated, the doctor’s report will give an opinion on the victim’s current state of health and its prospects for development. He will propose a new examination date to the victim, by which time consolidation is likely to have taken place.
