Article R4221-14-6 of the French Public Health Code

I. – When they wish to benefit from a temporary work permit in application of the provisions of the fifth paragraph of article L. 4221-12, persons who are refugees, stateless persons or beneficiaries of territorial asylum or subsidiary protection and French nationals who have returned to France at the request of the French authorities, and who hold a diploma, certificate or other evidence of formal qualifications allowing them, in the country in which it was obtained, to practise the profession of pharmacist, send the director general of the regional health agency in their place of residence, by any means that provides a date certain upon receipt, a dossier, the composition of which is set by order of the Minister for Health.

This application must include a commitment to work in a structure approved for training students in the third cycle of pharmacy studies. If the candidate is unable to provide such a commitment, the director general of the regional health agency will propose one or more host structures.

On receipt of a complete application, the general director of the regional health agency, after checking the documents submitted, issues a temporary practice permit. The Director General will assign the candidate to the facility that has undertaken to take him or her in, or to a facility that has been proposed to him or her and with which he or she has agreed.

If the candidate is hosted by a private or public interest establishment, he/she is assigned to the university hospital centre of the subdivision in which this establishment is located. He/she is made available by means of an agreement.

II. – The temporary authorisation to practise ends :

– if the applicant fails, without compelling reason, to take the knowledge verification tests under the conditions provided for in the second paragraph of article R. 4221-14-7 or if he has failed these tests four times ;

– on the effective date of the assignment of the candidate who has passed the knowledge verification tests to a health establishment with a view to completing the skills consolidation programme;

– if the candidate refuses to complete the skills consolidation programme.

Article R4221-14-6

I. – Lorsqu’elles souhaitent bénéficier d’une autorisation d’exercice temporaire en application des dispositions du cinquième alinéa de l’article L. 4221-12, les personnes ayant la qualité de réfugié, d’apatride ou de bénéficiaire de l’asile territorial ou de la protection subsidiaire et les Français ayant regagné le territoire national à la demande des autorités françaises, titulaires d’un diplôme, d’un certificat ou d’un autre titre permettant, dans le pays où il a été obtenu, d’exercer la profession de pharmacien, transmettent au directeur général de l’agence régionale de santé de leur lieu de résidence, par tout moyen donnant date certaine à sa réception, un dossier dont la composition est fixée par arrêté du ministre chargé de la santé.

Ce dossier comprend notamment un engagement d’accueil dans une structure agréée pour la formation des étudiants en troisième cycle des études de pharmacie. Dans le cas où le candidat ne peut présenter un tel engagement, le directeur général de l’agence régionale de santé lui propose une ou plusieurs structures d’accueil.

Saisi d’un dossier complet, le directeur général de l’agence régionale de santé, après vérification des pièces produites, délivre une autorisation d’exercice temporaire. Il affecte le candidat dans la structure qui s’est engagée à l’accueillir ou une structure qui lui a été proposée et qui recueille son accord.

Dans le cas où le candidat est accueilli dans un établissement privé d’intérêt collectif ou privé, il est affecté dans le centre hospitalier universitaire de la subdivision dans laquelle cet établissement est situé. Il est mis à disposition par voie de convention.

II. – La validité de l’autorisation d’exercice temporaire prend fin :

– si le candidat s’abstient, sans motif impérieux, de présenter les épreuves de vérification des connaissances dans les conditions prévues au second alinéa de l’article R. 4221-14-7 ou s’il a échoué à ces épreuves à quatre reprises ;

– à la date de prise d’effet de l’affectation du candidat reçu aux épreuves de vérification des connaissances dans un établissement de santé en vue de la réalisation du parcours de consolidation des compétences ;

– en cas de refus de ce candidat de réaliser le parcours de consolidation des compétences.
