I. – When they wish to benefit from a temporary work permit in application of the provisions of the fifth paragraph of article L. 4221-12, persons who are refugees, stateless persons or beneficiaries of territorial asylum or subsidiary protection and French nationals who have returned to France at the request of the French authorities, and who hold a diploma, certificate or other evidence of formal qualifications allowing them, in the country in which it was obtained, to practise the profession of pharmacist, send the director general of the regional health agency in their place of residence, by any means that provides a date certain upon receipt, a dossier, the composition of which is set by order of the Minister for Health.
This application must include a commitment to work in a structure approved for training students in the third cycle of pharmacy studies. If the candidate is unable to provide such a commitment, the director general of the regional health agency will propose one or more host structures.
On receipt of a complete application, the general director of the regional health agency, after checking the documents submitted, issues a temporary practice permit. The Director General will assign the candidate to the facility that has undertaken to take him or her in, or to a facility that has been proposed to him or her and with which he or she has agreed.
If the candidate is hosted by a private or public interest establishment, he/she is assigned to the university hospital centre of the subdivision in which this establishment is located. He/she is made available by means of an agreement.
II. – The temporary authorisation to practise ends :
– if the applicant fails, without compelling reason, to take the knowledge verification tests under the conditions provided for in the second paragraph of article R. 4221-14-7 or if he has failed these tests four times ;
– on the effective date of the assignment of the candidate who has passed the knowledge verification tests to a health establishment with a view to completing the skills consolidation programme;
– if the candidate refuses to complete the skills consolidation programme.
