Article R423-11 of the French Insurance Code

The articles of association of the policyholders’ guarantee fund determine the composition of the management board, the term of office of its members, the conditions for their replacement and the procedures for convening and holding meetings of the members of the fund’s governing bodies.

Its internal regulations set the conditions for the operation of the fund, for the payment of sums due to policyholders, subscribers or beneficiaries of benefits, or to transferee companies, and for the recovery of contributions from subscribing companies and late payment penalties as provided for in article L. 423-7, as well as the rules governing the keeping of the fund’s accounts.

Les statuts du fonds de garantie des assurés déterminent la composition du directoire, la durée du mandat de ses membres, les conditions de leur remplacement, ainsi que les modalités de convocation et de réunion des membres des organes dirigeants du fonds.

Son règlement intérieur fixe les conditions de fonctionnement du fonds, de versement des sommes dues aux assurés, souscripteurs de contrats, adhérents ou bénéficiaires de prestations, ou aux entreprises cessionnaires, et de recouvrement des cotisations des entreprises adhérentes et des pénalités de retard prévues à l’article L. 423-7, ainsi que les règles relatives à la tenue de la comptabilité du fonds.
