The Autorité de contrôle prudentiel et de résolution may set a different reduction rate for each set of contracts with the same characteristics. All contracts in the same group have the same reduction rate.
If the Autorité de contrôle prudentiel et de résolution decides to transfer all or part of the contracts to one or more undertakings, it shall arrange, at the expense of the defaulting undertaking, for the assets of the latter to be valued in order to allocate them. The Autorité de contrôle prudentiel et de résolution notifies each transferee undertaking of the list of assets accompanying the portfolio transfer.
If the Autorité de contrôle prudentiel et de résolution considers that the proposed reduction rates are excessive, it may, on the basis of the assessment referred to in the previous paragraph, ask the undertakings which responded to the invitation to tender to improve their offer within a time limit which it shall set. In the absence of a satisfactory response, it may reject their application.
If the failing company carried out operations covered by article L. 441-1, article L. 134-1, article L. 143-1 and article L. 144-2 of the Insurance Code, the assets allocated to these operations are allocated to the assignees of the corresponding commitments.
