The liquidator shall apply to the policyholders’ guarantee fund for the payment provided for in the second paragraph of article L. 423-3, which it shall calculate on the basis of the commitments as at the date of cessation of the effects of the contracts, determined in accordance with the conditions set out in articles L. 326-12 and L. 326-13. Within two months of the date of receipt of this request, the fund, after verifying that the contracts are covered by the guarantee and checking the amount guaranteed per contract, will make a one-off payment to each policyholder, contract subscriber or beneficiary of benefits in return for a receipt of payment.
In exceptional circumstances, the Autorité de contrôle prudentiel et de résolution may, at the request of the guarantee fund, grant an extension of no more than three months to the period stipulated in the previous paragraph.
The guarantee fund shall implement the guarantee, in accordance with the same procedure, if the liquidator submits an additional request for payment, providing proof that the policyholders, contract holders, members or beneficiaries of benefits concerned were unable to present the contracts eligible for the guarantee in time.
The sums owed by the guarantee fund and not paid bear interest at the legal rate from the date of expiry of the period allowed to the fund to make the payment.
Where applicable, the guarantee fund has a period of two months from the date of payment provided for in the first paragraph of this article to submit a request for repayment to the policyholder, subscriber or beneficiary of benefits concerned.
