Article R423-8 of the French Insurance Code

As soon as it has been notified in accordance with I of article L. 423-2, the defaulting company shall inform each policyholder, subscriber or beneficiary of benefits of the proceedings in progress.

The formalities to be completed by the company transferring the portfolio of contracts in order to benefit from the payment by the guarantee fund of the guarantee provided for in the first paragraph of article L. 423-3 are specified by the internal regulations of the guarantee fund. The formalities to be completed by the liquidator in order to enable the payment of this guarantee to policyholders, contract holders, members or beneficiaries of benefits are also specified by the same internal regulations.

Dès la notification prévue au I de l’article L. 423-2, l’entreprise défaillante informe chaque assuré, souscripteur de contrats, adhérent ou bénéficiaire de prestations de la procédure en cours.

Les formalités à remplir par l’entreprise cessionnaire du portefeuille de contrats pour bénéficier du versement par le fonds de la garantie prévu au premier alinéa de l’article L. 423-3 sont précisées par le règlement intérieur du fonds de garantie. Celles qui devront être accomplies par le liquidateur en vue de permettre le versement de cette garantie aux assurés, souscripteurs de contrats, adhérents ou bénéficiaires de prestations sont également précisées par ce même règlement intérieur.
