Article R424-15 of the French Insurance Code

The Estates Department will provide an estimate of the value of the agricultural or forestry land affected by the claim for compensation, in the event that the damage has not occurred, within two months of the claim being referred to it by the Prefect.

Improvements of any kind, such as plantations, various installations, acquisitions of goods, which may have been made to the parcel or parcels concerned do not give rise to any compensation if, due to the time at which these improvements were made, or any other circumstances, it appears that they were made with the aim of obtaining higher compensation.

Le service des domaines transmet une estimation de la valeur des terres agricoles ou forestières concernées par la demande d’indemnisation, au cas où le dommage ne se serait pas produit, dans les deux mois après sa saisine par le préfet.

Les améliorations de toute nature, telles que plantations, installations diverses, acquisitions de marchandises, qui auraient été faites à la ou les parcelles concernées ne donnent lieu à aucune indemnité si, en raison de l’époque à laquelle ces améliorations ont eu lieu, ou de toutes autres circonstances, il apparaît qu’elles ont été faites dans le but d’obtenir une indemnité plus élevée.
