Article R424-16 of the French Insurance Code

The Prefect shall arrange for an assessment of the losses suffered by the farmers.

To assess these losses, the scale provided for in article D. 361-14 of the French Rural and Maritime Fishing Code and the principles set out in article D. 361-27 of the same code are applied. This assessment is based on the latest scale in force on the date the application for compensation is submitted.

The prefect sends his proposals to the ministers responsible for the environment and the economy respectively within three months of his referral as mentioned in article R. 424-14.

Article R424-16

Le préfet fait procéder à l’évaluation des préjudices subis par les exploitants.

Pour l’évaluation de ces préjudices, il est fait application du barème prévu à l’article D. 361-14 du code rural et de la pêche maritime ainsi que des principes énoncés à l’article D. 361-27 du même code. Cette évaluation est basée sur le dernier barème en vigueur à la date du dépôt du dossier de demande d’indemnisation.

Le préfet adresse ses propositions aux ministres chargés respectivement de l’environnement et de l’économie dans un délai de trois mois à compter de sa saisine telle que mentionnée à l’article R. 424-14.
