Article R426-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

By way of derogation from article R. 431-3, foreign nationals residing outside France who are applying for the issue of a residence permit bearing the wording “retired person” provided for in article L. 426-8 or its renewal may submit their application to the French consular representation in their country of residence, which will forward their application to the territorially competent prefect.

Par dérogation à l’article R. 431-3, l’étranger résidant hors de France qui sollicite la délivrance de la carte de séjour portant la mention ” retraité ” prévue à l’article L. 426-8 ou son renouvellement peut déposer sa demande auprès de la représentation consulaire française dans son pays de résidence, qui transmet sa demande au préfet territorialement compétent.
