A foreign national who serves or has served in the Foreign Legion and holds the resident card provided for in article L. 426-3 may have it withdrawn if his certificate of good conduct has been withdrawn.
By way of derogation from article R. 431-3, foreign nationals residing outside France who are applying for the issue of a residence permit bearing the wording “retired person” provided for in article L. 426-8 or its renewal may submit their application to the French consular representation in their country of residence, which will forward their application to the territorially competent prefect.
By way of derogation from article R. 431-20, when the holder has already left France, the residence permit bearing the wording “retired person” provided for in article L. 426-8 is issued by the prefect of the département in which the foreign national declares that he or she wishes to reside, even temporarily, and, in Paris, by the police prefect.
When applying for a temporary or multi-annual residence permit under the conditions mentioned in article L. 426-11, foreign nationals holding a resident permit bearing the words “long-term resident-EU” granted in another European Union Member State must submit their application within three months of entering France.
When a foreign national who already has a residence permit bearing the words “long-term resident-EU” issued by another European Union Member State is recognised as a refugee or granted the benefit of subsidiary protection in France, the Prefect or, in Paris, the Police Prefect, will inform the authorities of that Member State so that they can amend the “Remarks” section of the interested party’s residence permit accordingly.
