Article R426-16 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Foreign nationals who come to France for one of the following reasons are considered as trainees for the purposes of obtaining a temporary residence permit bearing the word “stagiaire” (trainee) as provided for in article L. 426-23:

1° To carry out a work placement in a company, as part of a training course organised in their country of residence which leads to the award of a diploma or title or to the recognition of a level of professional qualification and which is part of a school or university course, vocational training or a European Union or intergovernmental cooperation programme in the fields of education, training, youth or culture;

2° As an employee of a company established abroad, subject to the provisions of articles L. 421-30 and L. 421-31, to follow a training course provided by a body referred to in article L. 6351-1 of the Labour Code, and, where applicable, to complete a work placement in a company with which their employer has commercial relations;

3° Complete a placement in a public or private not-for-profit healthcare establishment with a view to receiving additional training leading to recognition of a level of professional qualification, within the framework of the cooperation agreement provided for in Article R. 6134-2 of the Public Health Code.

Article R426-16

Pour l’obtention de la carte de séjour temporaire portant la mention ” stagiaire ” prévue à l’article L. 426-23, est considéré comme stagiaire l’étranger qui vient en France pour l’une des raisons suivantes :

1° Effectuer un stage en entreprise, dans le cadre d’une formation organisée dans son pays de résidence qui conduit à la délivrance d’un diplôme ou d’un titre ou à la reconnaissance d’un niveau de qualification professionnelle et qui relève d’un cursus scolaire ou universitaire, d’une formation professionnelle ou d’un programme de coopération de l’Union européenne ou intergouvernemental dans les domaines de l’éducation, de la formation, de la jeunesse ou de la culture ;

2° En tant que salarié d’une entreprise établie à l’étranger, sous réserve des dispositions des articles L. 421-30 et L. 421-31, pour suivre une formation dispensée par un organisme mentionné à l’article L. 6351-1 du code du travail, et, le cas échéant, effectuer un stage dans une entreprise avec laquelle son employeur entretient des relations commerciales ;

3° Effectuer un stage dans un établissement de santé public ou privé à but non lucratif en vue de bénéficier d’une formation complémentaire conduisant à la reconnaissance d’un niveau de qualification professionnelle, dans le cadre de la convention de coopération prévue à l’article R. 6134-2 du code de la santé publique.
