Article R426-20 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The training agreement is sent to the prefect using a teleservice, within the meaning of article L. 112-9 of the code of relations between the public and the administration, or by registered letter with acknowledgement of receipt at least two months before the start date of the training period by the company, training organisation or public or private not-for-profit health establishment wishing to host a trainee.
The prefect will approve the internship agreement within thirty days of receiving it; he will forward it to the foreign national and inform the person who forwarded it. The Prefect will refuse to approve the agreement if the reality of the planned work placement has not been established, if the agreement does not comply with the provisions of article R. 426-19 or if the host company does not comply with employment or social protection legislation; in this case, he will notify the foreign national of his decision to refuse and return the agreement to the person who forwarded it to him. If the prefect remains silent for thirty days, this will be deemed to be a rejection decision.
The period referred to in the first paragraph is reduced to one month, and that referred to in the second paragraph to fifteen days when the work placement is part of a European Union or intergovernmental cooperation programme.

La convention de stage est adressée au préfet au moyen d’un téléservice, au sens de l’article L. 112-9 du code des relations entre le public et l’administration, ou par lettre recommandée avec demande d’avis de réception au moins deux mois avant la date de début du stage par l’entreprise, l’organisme de formation ou l’établissement de santé public ou privé à but non lucratif qui souhaite accueillir un stagiaire.


Le préfet vise la convention de stage dans les trente jours suivant sa réception ; il la transmet à l’étranger et en informe la personne qui la lui a transmise. Il refuse de viser la convention si la réalité du projet de stage n’est pas établie, si la convention n’est pas conforme aux dispositions prévues par l’article R. 426-19 ou lorsque l’entreprise d’accueil ne respecte pas la législation relative au travail ou à la protection sociale ; dans ce cas, il notifie sa décision de refus à l’étranger et renvoie la convention à la personne qui la lui a transmise. Le silence gardé pendant trente jours par le préfet vaut décision de rejet.


Le délai mentionné au premier alinéa est ramené à un mois, et celui mentionné au deuxième alinéa à quinze jours lorsque le stage relève d’un programme de coopération de l’Union européenne ou intergouvernemental.
