Article R426-19 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The placement agreement is concluded between the trainee, the training establishment or the employer established abroad and the host company in France or the training organisation mentioned in article L. 6351-1 of the French Labour Code.
The work placement agreement includes the clauses provided for by the decree adopted for the application of the second paragraph of article L. 124-1 of the Education Code, except where one of these clauses is clearly not applicable.
In the case provided for in 1° of article R. 426-16, the trainee receives a bonus under the conditions provided for by article L. 124-6 of the Education Code.
In the case provided for in 3° of article R. 426-16, the placement agreement is concluded between the trainee, the host establishment, the organisation that is party to the international cooperation agreement mentioned in article L. 6134-1 of the Public Health Code and, if different, the organisation responsible for reimbursing the elements of remuneration.
The training agreement may not confer on the trainee the status of employee in the company or health establishment receiving him/her.

La convention de stage est conclue entre le stagiaire, l’établissement de formation ou l’employeur établi à l’étranger et l’entreprise d’accueil en France ou l’organisme de formation mentionné à l’article L. 6351-1 du code du travail.
La convention de stage comporte les clauses prévues par le décret pris pour l’application du deuxième alinéa de l’article L. 124-1 du code de l’éducation, sauf lorsque l’une de ces clauses est manifestement sans objet.
Dans le cas prévu au 1° de l’article R. 426-16, le stagiaire bénéficie d’une gratification dans les conditions prévues par l’article L. 124-6 du code de l’éducation.
Dans le cas prévu au 3° de l’article R. 426-16, la convention de stage est conclue entre le stagiaire, l’établissement d’accueil, l’organisme partie à la convention de coopération internationale mentionnée à l’article L. 6134-1 du code de la santé publique et, s’il est différent, l’organisme qui prend en charge le remboursement des éléments de rémunération.
La convention de stage ne peut pas conférer au stagiaire la qualité de salarié dans l’entreprise ou dans l’établissement de santé qui le reçoit.
