Article R4383-4 of the French Public Health Code

In order to qualify for the approval referred to in article L. 4383-3, the directors of training institutes or schools for the professionals mentioned in Titles I to VII of this book, nursing auxiliaries, childcare assistants, ambulance drivers and medical biology laboratory technicians must meet the age and diploma requirements set by order of the Minister for Health, and must not have been convicted of any offence recorded in bulletin no. 2 of the national criminal record.

Approval for directors of institutes or schools under the authority of a public health institution is granted in compliance with the statutory provisions governing staff covered by Title IV of the General Statute for Civil Servants and the legal and regulatory provisions applying to public employees.

The duties, tasks and obligations of the directors of the institutes or schools referred to in the first paragraph of this article, other than those governed by Title IV of the General Statute for Civil Servants, are set by order of the Minister for Health.

Pour bénéficier de l’agrément mentionné à l’article L. 4383-3, les directeurs des instituts ou écoles de formation des professionnels mentionnés aux titres Ier à VII du présent livre, des aides-soignants, des auxiliaires de puériculture, des ambulanciers et des techniciens de laboratoires d’analyses de biologie médicale doivent remplir des conditions d’âge et de diplômes fixées par arrêté du ministre chargé de la santé, et ne pas avoir fait l’objet d’une condamnation inscrite au bulletin n° 2 du casier judiciaire national.

L’agrément des directeurs des instituts ou écoles relevant d’un établissement public de santé est délivré dans le respect des dispositions statutaires régissant les personnels relevant du titre IV du statut général des fonctionnaires et des dispositions légales et réglementaires s’appliquant aux agents publics.

Les fonctions, les missions et les obligations des directeurs des instituts ou écoles mentionnés au premier alinéa du présent article autres que ceux régis par le titre IV du statut général des fonctionnaires sont fixées par arrêté du ministre chargé de la santé.
