Article R*441-13 of the French Insurance Code

The collective operations defined in article R. 441-4 give rise to the conclusion of agreements between the insurance undertaking and an intermediary within the meaning of article L. 511-1, acting on behalf of the said undertaking, which may collect the contributions and may provide benefits on behalf of the said undertaking.

The contributions paid by the contributors may not be redistributed by the intermediary.

The provision of benefits by the intermediary may not involve a redistribution of the said benefits on bases other than those laid down in the agreement referred to in the first paragraph of this article.

Les opérations collectives définies à l’article R. 441-4 donnent lieu à la souscription de conventions entre l’entreprise d’assurance et un intermédiaire au sens de l’article L. 511-1, mandataire de ladite entreprise, qui peut collecter les cotisations et peut effectuer le service des prestations pour le compte de cette entreprise.

Les cotisations versées par les cotisants ne peuvent faire l’objet d’aucune redistribution de la part de l’intermédiaire.

Le service des prestations effectué par l’intermédiaire ne peut comporter une redistribution desdites prestations sur des bases différentes de celles fixées dans la convention mentionnée au premier alinéa du présent article.
